§ 1 Scope of application

These general terms and conditions (GTC) apply to all events organized by FremdSprachenSchule for everyone GmbH, hereinafter referred to as Fremdsprachenschule for everyone.

§ 2 Services

The foreign language school for everyone offers language training in the form of individual and group lessons, continuing education courses, integration courses, corporate courses, courses for children, as well as tutoring and tests. These courses are taught by freelance instructors.

The course content is primarily based on school curricula, the CEFR for languages, and the course programs and content specified by the foreign language school. The foreign language school reserves the right to make changes to the program and content.

If deficiencies arise during lessons, the foreign language school for everyone must be informed immediately so that these deficiencies can be remedied.

The foreign language school accepts no liability for participation and failure to achieve learning success.

§ 3 Participation

Participation in training programs, courses, and classes at the foreign language school is open to everyone. If a course has specific admission or performance requirements, these must be met or proven.

§ 4 Registration

Registration can be done in person, by telephone, email, post, online, or by a third party. Participants under the age of 18 require the signature of a legal guardian when registering.

Registration implies acceptance of the General Terms and Conditions, which become part of the contract. Each binding registration obliges the participant to pay the course and test fees. By registering, the participant undertakes to attend classes and/or test events regularly. Participants are not entitled to request a specific instructor, branch, and/or classroom.

§ 5 Course fees, test fees, and payment

The fees are usually shown for the entire period as well as for individual lessons (45 minutes). The amount of the fees to be paid depends on the services booked. Lessons always take place in the form of at least one double lesson (two lessons).

Cancellation of registration and refunds are generally excluded. Exceptions to this are described in § 7. The course fee is due immediately after registration and must be paid in advance for the entire course (for modular courses, in advance for each module) and must be received in the foreign language school’s account no later than the day before the course begins:

As long as the course fee has not been paid, the foreign language school is entitled to reallocate the place.

It is possible to arrange payment by installments for individual lesson contracts. If payment by installments is desired, an installment payment application must be submitted and a processing fee of €20 must be paid. The course fee will then be divided into a maximum of 3 installments, which are usually payable after every 10 double lessons. If payment is not made on time, a reminder fee of €5 may be charged.

The teaching materials are not included in the course fee. Participants undertake to purchase and use the teaching materials specified by the foreign language school for the course they have booked.

§ 6 Start date, duration, and class dates

The start and duration of the courses, as well as the times and locations of classes, can be found in the program. The announcement of events is non-binding. Dates are subject to change and require confirmation. No events take place on public holidays.

In the event that lessons in a group course are missed (e.g. due to illness, vacation, etc.), there is no entitlement to a replacement lesson or a refund. If lessons are canceled by the foreign language school (e.g. due to illness of the teacher), the lessons can be made up. The foreign language school has the right to use a substitute teacher if necessary. If the number of participants is too low, the foreign language school may cancel group courses or reduce the number of lessons.

For individual lessons, the lesson times and start date are bindingly agreed upon by the course participants at the beginning of the course. All lessons agreed upon in the contract must be taken within a period of 10 weeks, 6 months, or a maximum of 12 months, depending on the duration of the course. A lesson is considered canceled if the course participant has not appeared 15 minutes after the start of the lesson. The fee for the canceled double lesson must be paid in full by the course participant if they have not canceled the appointment by 2 p.m. the day before (Mon to Fri) at the latest. Appointments canceled in good time must be made up within the deadline. A free extension of the deadline is only possible if the lesson is canceled by the foreign language school (e.g., due to illness or unavailability of the teacher).

§ 7 Withdrawal by the participant and the foreign language school

Withdrawal is generally excluded and will only be approved by the foreign language school in exceptional cases. It must be made in writing and is only possible under exceptional circumstances. An important reason exists if, taking into account all circumstances of the individual case and weighing the interests of both parties, the course participant cannot reasonably be expected to continue the contractual relationship until the agreed termination date. This includes moving away from the area where the foreign language school is located by 100 km or more. Failure to attend does not constitute withdrawal. This does not apply to the 14-day right of withdrawal for online registrations via the online registration form.

Cancellation is not possible for bookings made from abroad. If the participant is unable to attend the course booked at the foreign language school for everyone for any reason (illness, visa refusal, work, etc.), the course fee is payable in full.

Withdrawal due to the participant feeling overburdened or underchallenged by the level of performance required in the course is not permitted.

In the event of withdrawal under the above conditions, a cancellation fee of €20 plus the pro-rata fees for expired appointments will be charged. In the event of withdrawal from individual lessons, the lessons taken will be charged at the prices stated on our registration form, depending on the number of hours.

The foreign language school may withdraw from the contract if §314 of the German Civil Code (BGB) is violated (anti-social behavior in the classroom; insults of any kind toward teachers, students, or school staff; discrimination against individuals; misuse of the course for party political purposes, agitation, or personal advertising purposes; as well as violation of the house rules).

§ 8 Accident insurance / Liability

Participants are not covered by accident insurance when attending the course. The foreign language school’s liability is limited to gross negligence and intent. Use of the teaching facilities is at your own risk. In particular, the foreign language school is not liable for loss of personal property.

§ 9 Data protection / Copyright protection

The foreign language school collects, processes, and uses personal data for administrative purposes to the extent necessary to fulfill the contract. The data will not be passed on to third parties. The data will be treated in accordance with the applicable data protection regulations.

All course participants must note that, in accordance with copyright law, copying and distributing teaching materials (software, textbooks, CDs) provided for teaching purposes is not permitted. Photography, filming, and audio recordings are generally not permitted during courses. Exceptions to this rule may only be granted by the management of the foreign language school.

§ 10 Modifications

Amendments to the General Terms and Conditions and subsidiary agreements must be made in writing to be effective.
